En concreto, el regulador espa\u00f1ol describe al producto <em>Skype-Out<\/em> como un servicio de comunicaciones, y por tanto, es exigible que, antes de su puesta en marcha, sea testeado por la propia CNMC.<\/p>\n<p style=\"text-align: justify;\">La CNMC apoya este expediente<sup class=\"modern-footnotes-footnote \" data-mfn=\"3\" data-mfn-post-scope=\"000000000000413c0000000000000000_603860\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-000000000000413c0000000000000000_603860-3\">3<\/a><\/sup><span id=\"mfn-content-000000000000413c0000000000000000_603860-3\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"3\"><a href=\"https:\/\/www.cnmc.es\/sites\/default\/files\/2956071_9.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/www.cnmc.es\/sites\/default\/files\/2956071_9.pdf<\/a><\/span> en dos poderosos argumentos. El primero, la sentencia del Tribunal de Justicia de la Uni\u00f3n Europea (TJUE) del 5 de junio de 2019<sup class=\"modern-footnotes-footnote \" data-mfn=\"4\" data-mfn-post-scope=\"000000000000413c0000000000000000_603860\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-000000000000413c0000000000000000_603860-4\">4<\/a><\/sup><span id=\"mfn-content-000000000000413c0000000000000000_603860-4\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"4\"><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/ES\/TXT\/HTML\/?uri=CELEX:62018CJ0142&amp;from=ES\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/eur-lex.europa.eu\/legal-content\/ES\/TXT\/HTML\/?uri=CELEX:62018CJ0142&amp;from=ES<\/a><\/span>, en donde confirmaba la naturaleza de Skype-Out como <em>\u00abservicio de comunicaciones electr\u00f3nicas\u00bb<\/em>, puesto que realiza \u201cuna funcionalidad que ofrece un servicio VoIP que permite al usuario llamar a un n\u00famero fijo o m\u00f3vil de un plan nacional de numeraci\u00f3n a trav\u00e9s de la RTPC de un Estado miembro\u201d. Esta demanda, interpuesta por el regulador de las telecos belga (IBTP), supuso una multa de 223.500 euros que tuvo que abonar Microsoft<sup class=\"modern-footnotes-footnote \" data-mfn=\"5\" data-mfn-post-scope=\"000000000000413c0000000000000000_603860\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-000000000000413c0000000000000000_603860-5\">5<\/a><\/sup><span id=\"mfn-content-000000000000413c0000000000000000_603860-5\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"5\"><a href=\"https:\/\/www.expansion.com\/juridico\/sentencias\/2019\/06\/05\/5cf7e895468aeb051a8b4685.html\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/www.expansion.com\/juridico\/sentencias\/2019\/06\/05\/5cf7e895468aeb051a8b4685.html<\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\">El segundo argumento se deriva del primero, al entender el regulador que es de inmediata aplicaci\u00f3n el art\u00edculo 76.2 de la LGT, infracciones graves, como consecuencia de un incumplimiento del obligatorio registro como operador de telecomunicaciones, \u201cpreviamente al inicio de la actividad\u201d, que Microsoft deber\u00eda haber realizado.<\/p>\n<p style=\"text-align: justify;\">Por todo ello, la CNMC requiere a Microsoft \u201cel cumplimiento inmediato de los requisitos establecidos en el art\u00edculo 6.2 de la Ley 9\/2014, de 9 de mayo, General de Telecomunicaciones, a trav\u00e9s de la comunicaci\u00f3n de su actividad de Skype-out al Registro de Operadores. La comunicaci\u00f3n deber\u00e1 producirse en el plazo de cinco d\u00edas h\u00e1biles o deber\u00e1 cesar la actividad en Espa\u00f1a al t\u00e9rmino del plazo concedido\u201d.<\/p>\n<p style=\"text-align: justify;\">El requerimiento tuvo un efecto casi inmediato, puesto que la empresa norteamericana solicit\u00f3 el registro de Skype-Out como operador fijo y m\u00f3vil solo unos d\u00edas despu\u00e9s, a\u00f1adiendo que se \u00abha mantenido una interacci\u00f3n constructiva con la CNMC sobre este tema y est\u00e1 tomando medidas para garantizar que las instrucciones se implementen de inmediato<sup class=\"modern-footnotes-footnote \" data-mfn=\"6\" data-mfn-post-scope=\"000000000000413c0000000000000000_603860\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-000000000000413c0000000000000000_603860-6\">6<\/a><\/sup><span id=\"mfn-content-000000000000413c0000000000000000_603860-6\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"6\"><a href=\"https:\/\/cincodias.elpais.com\/cincodias\/2020\/06\/05\/companias\/1591369710_540391.html\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/cincodias.elpais.com\/cincodias\/2020\/06\/05\/companias\/1591369710_540391.html<\/a><\/span>\u00ab.<\/p>\n<h4 style=\"text-align: right;\"><strong><span style=\"color: #ff0000;\">UGT<\/span> Comunicaciones<\/strong><\/h4>\n","protected":false},"excerpt":{"rendered":"<p>Problemas para Microsoft, due\u00f1a de la aplicaci\u00f3n de mensajer\u00eda y video-llamadas Skype y de su producto Skype-Out.
